Explanatory Statement
FairShare Vacation Rental Management Ltd (“FairShare”, “we”, “us”) acts as the booking and management agent for vacation property owners.
This Short-Term Rental Agreement (“Agreement”) is between FairShare and the Guest (“you”) for the use of a vacation property (“Premises”) during your booked stay.
By completing your booking, you agree to the terms below.
Terms And Conditions
1. License to Use the Property
We grant you a temporary, non-transferable license to use the Premises for vacation purposes only.
2. Use of the Property
The property is for vacation lodging only, including normal activities such as relaxing, dining, and relaxation.
a. Prohibited Use
You agree not to break any laws, engage in unsafe or hazardous activities, or disturb other guests of residents
b. Guest Limits
Only the number of guests listed in your booking are allowed. Additional guests must be approved at least 7 days in advance.
c. All stays must follow FairShare’s policies (Appendix A and posted rules). Violations may result in termination of your stay without refund.
3. Responsible Guest
You, the guest, represent and warrant that you are 18 years of age or older. The Responsible Guest is responsible for payment, deposits, and all other Guest responsibilities stated in this Agreement.
4. Fees & Charges
Your total cost includes accommodation (license fee), cleaning fees, taxes and any applicable service or damage protection fees. If Alberta and/or the local governments increase taxes, any additional tax will be due prior to the departure of the stay.

By booking, you authorize FairShare to charge your card for all amounts due and any additional charges or damages.

8. Cancellation Policy:
To cancel a confirmed reservation, please message us via your booking platform, email info@fspropertymanagement.com or call us at 1800 605 0075 as soon as you know.
9. Condition of the Premises; Disclaimer of Warranties:
We aim to provide a clean and well-maintained property; however, we do not own the property and we cannot guarantee all appliances or features. You agree to leave the property in similar condition as arrival.
10. Liability Limitations
FairShare is not responsible for:
Our total liability is limited to the amount we received for your stay.
11. Indemnification:
You agree to be responsible for any claims, damages, losses, or costs (including legal fees) that arise from:
This does not apply to issues caused directly by the negligence or willful misconduct of FairShare or the property owner.
12. Additional Terms
a. Property Access: We may enter the property for maintenance or emergencies and will provide advanced notice whenever possible. If an emergency requires entry without notice, or on short notice, to prevent or mitigate harm to person or property, you agree that such entry would be reasonable with such notice, if any, as is practicable under the circumstances.
b. Supplies: Basic linens and towels are provided. No daily housekeeping is provided but can be arranged for an additional fee subject to availability.
c. Late Checkout: Late checkout without approval may result in an additional night’s charge.
d. Administrative Fees: Additional fees may apply for rule violations or operational disruptions.
13. Violation Fees (Whenever applicable to the Premises):
The following fees may be charged if rules are not followed:
Additional cleaning, repair, or replacement costs beyond these fees may also be charged if required.
14. Other Violations:
a. Damage or Destruction: If the property becomes unsafe or uninhabitable due to fire or other unforeseen events, this Agreement will end and you will receive a refund for any unused nights.
b. Governing Law: This agreement is governed by the laws of the Province of Alberta.
c. Any legal disputes must be handled in Alberta, in the jurisdiction where the property is located. The successful party may recover reasonable legal costs.
d. Entire Agreement: This document (including Appendix A) represents the full agreement between both parties and replaces any previous discussions or agreements. This contract is legally binding 24 hours after making your reservation. If you have any questions, please call us immediately.
e. Binding Agreement: This Agreement applies to and benefits both parties and their respective successors.
f. Non-Assignable: You may not transfer or assign your booking or rights under this Agreement without approval.
1. Check-In Time: Check in is after 4:00 p.m.
2. Check-Out Time: Check out is no later than 11:00 a.m.
3. Cleaning: The Premises are cleaned after every License Period.

5. Smoking Policy: Smoking is not allowed at the Premises at any time, including
garage, porches, or balconies. You will be responsible for ALL costs associated with
the removal of the presence of smoke if smoking on the Premises should occur.
6. Lost and Found: If you leave something behind, call us and we will make every effort to locate and return it to you. Items unclaimed after 30 days will be donated to a local charity. We are not responsible for items left behind.
7. Repairs: If you have an emergency involving the condominium, please call us at 1800 605 0075 8.30 am to 6 pm and 825 804 4349 for all other hours.
8. Prohibited Items: You may not bring or keep any illegal substances, hazardous materials, or flammable, explosive, or otherwise dangerous items on the Premises.
9. Noise & Respect: You must always keep noise levels within the Premises at a reasonable level and must not do anything that might interfere with the use of other units near the Premises.
10. Parking: You must obey all parking signs and posted regulations and restrictions in connection with the Premises.
